Section 01
Definitions
1.1"Company" means Hunt 4 Spares Ltd.
1.2"Customer" means the purchaser of Goods from the Company.
1.3"Consumer" means an individual acting for purposes outside their trade or business.
1.4"Trade Customer" means a person or business purchasing in the course of trade.
1.5"Goods" means any parts or products supplied by the Company.
1.6"Manufacturer" means the original producer of the Goods.
Section 02
Application of Terms
2.1These Terms apply to all sales of Goods by the Company.
2.2Where the Customer is a Consumer, statutory rights under UK consumer law are not affected.
2.3Where the Customer is a Trade Customer, the provisions specific to trade sales (Section 4) apply.
2.4By purchasing Goods, the Customer agrees to be bound by these Terms.
Section 03
Consumer Sales (B2C)
3.1Goods must be as described, of satisfactory quality, and fit for purpose in accordance with the Consumer Rights Act 2015.
3.2Consumers may have the right to:
Reject faulty Goods within 30 days of purchase for a full refund
Request repair or replacement
Receive a refund if repair or replacement is not possible
3.3These rights apply only where a fault is not caused by:
Incorrect installation
Misuse or modification
Normal wear and tear
3.4The Company may require inspection or testing of Goods before confirming a fault.
3.5Any Manufacturer warranty is provided in addition to (not instead of) statutory rights.
Section 04
Trade Sales (B2B)
4.1All trade sales are conducted in the course of business.
4.2The Customer confirms they are not acting as a Consumer.
4.3To the fullest extent permitted by law:
All implied terms are excluded
Goods are supplied subject only to the Manufacturer's warranty
4.4The Customer is responsible for ensuring Goods are suitable for their intended use.
Section 05
Product Suitability
5.1The Customer is responsible for confirming compatibility and correctness of parts before purchase and installation.
5.2The Company accepts no liability for incorrect parts ordered or fitted.
Section 06
Warranty
6.1Goods are covered only by the Manufacturer's warranty where applicable.
6.2The Company does not provide any additional warranty unless agreed in writing.
6.3Warranty claims are subject to the Manufacturer's terms and approval process.
6.4The Company is not liable where a Manufacturer:
(a) Ceases trading or becomes insolvent; or
(b) Refuses or is unable to honour a warranty
Section 07
No Durability Guarantee
7.1The Company does not guarantee lifespan, mileage, or durability of Goods.
7.2Performance and lifespan may be affected by usage, installation, and external factors.
7.3Any estimates provided are for guidance only and do not form part of the contract.
Section 08
Limitation of Liability
8.1Nothing in these Terms excludes liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
Any rights that cannot be excluded by law
8.2For Trade Customers only, the Company's liability is limited to the value of the Goods supplied.
8.3The Company shall not be liable (for Trade Customers) for:
Labour costs
Loss of earnings
Vehicle downtime
Transport or recovery costs
Indirect or consequential losses
Note for Trade Customers: Liability is strictly capped at the invoice value of the Goods in question. No consequential or indirect losses are recoverable.
Section 09
Returns & Claims
9.1Returns must be authorised in advance.
9.2Goods must be unused and in original packaging unless faulty.
9.3For Trade Customers, returns may be refused after 30 days.
9.4Faulty Goods must be inspected before replacement or refund is issued.
Section 10
Installation
10.1Goods should be fitted by a qualified professional.
10.2Incorrect installation, misuse, or modification will invalidate any warranty.
Section 11
Title & Risk
11.1Risk passes to the Customer upon delivery.
11.2Ownership remains with the Company until full payment is received.
Section 12
Payment Terms
12.1Payment terms are as stated on the invoice.
12.2The Company may charge interest on overdue accounts in accordance with applicable law.
Section 13
Force Majeure
13.1The Company shall not be liable for failure to perform obligations due to events beyond its reasonable control.
Section 14
Governing Law
14.1These Terms are governed by the laws of England and Wales.
Section 15
Acceptance
15.1By purchasing Goods, the Customer confirms acceptance of these Terms.
By purchasing from Hunt 4 Spares Ltd, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions of Sale.
